The Differences Between ITAS and ITAP in Indonesia

Planning to settle down in Indonesia but confusing which visa you need? This is such situation faced for the foreigners who wish, are assigned, or move to Indonesia for work, family, or other reasons.

 

The complicated regulation or visa policies in Indonesia can make the visa application legal process more complex or unpredictable than it should be. In the case of stay visas in Indonesia, this is particularly pronounced. Due to the difference among visas and the required documents, such as E-ITAS & KITAS, and E-ITAP and KITAP.

E-ITAS and KITAS in Indonesia,

E-ITAS stands for Izin Tinggal Terbatas Elektronik or Electronic Limited Stay Permit, and KITAS Stands for Kartu Izin Tinggal Terbatas or Limited Stay Permit Card, both of them are the same thing. However, for KITAS, there is no card/Kartu issued by Indonesian immigration. Instead, a limited stay visa is given out electronically, and thus it is now mostly called as simply as an ITAS or e-ITAS.

 

TYPES OF ITAS (KITAS)

 

e-ITAS can be dividual into four main categories, there are:

 

ITAS for Work Visa

Work visa can only be sponsored by a Company, Organization, or Representative Office that is duly organized, existing, and registered under the laws of the Republic of Indonesia. The validity of the work permit impacts the duration of the ITAS as well and is available with Multiple Exits and Re-entry Permits (MERP).

 

ITAS for Spouse Visa or Family Visa

A foreigner who is legally married to an Indonesian citizen (spouse-sponsored) is qualified to apply for a spouse ITAS. The foreigner is only allowed to stay in Indonesia but prohibited to work in Indonesia. However, the foreigner can still work in Indonesia but a work permit is required in order to be legally employed in Indonesia.

 

The validity of a spouse-sponsored ITAS is one year and is extendable for five-time with the same validity, such as one year, spouse ITAS holders are not limited by the number of entries to Indonesia.

 

ITAS for Investor Visa

Investor ITAS is similar to a work visa, the foreigner can only be sponsored by a company that has shared at that company that duly organized, existing, and registered under the laws of the Republic of Indonesia. The validity of Investor Visa impacts the duration of the ITAS as well and is available with Multiple Exits and Re-entry Permits (MERP).

 

ITAS for Retirement Visa

With this type of visa, foreigners do not need to be employed or start a business in Indonesia to acquire this visa. However, not all nationalities are entitled to a retirement visa in Indonesia. However, the foreigners who hold this visa are not allowed to work in Indonesia.

 

A retirement visa is valid for one year and can be extended up to five times.

 

 

E-ITAP and KITAP in Indonesia

 

ITAP and KITAP are the same visas, and the “K” is mean Card/Kartu, E-ITAP (Elektornik Izin Tinggal Tetap or Electronic Permanent Stay Permit) or KITAP (Kartu Izin Tinggal Tetap or Permannent Stay Permit Card) is a permanent residency visa for foreigners staying and living in Indonesia. It has a validity of five years, and an unlimited number of extensions is allowed.

 

In order to the Immigration Law or Regulations in Indonesia, an ITAP or KITAP can only be given to the following foreigners:

  • a foreigner who has a limited stay visa (E-ITAS) as an expat, investor, retiree, or religious missionary for the required time;
  • a member (for example a child) of a mixed marriage family;
  • a spouse or a child of a foreigner or an expat who holds a permanent stay visa; and
  • a foreigner who was previously an Indonesian citizen or possessed dual citizenship of Indonesia and another country.

 

 

Restriction for Spouse-sponsored ITAS/ITAP and ITAS for Retirement ITAS

 

Under the Law and Regulations of Indonesia, as a general consensus that holders of spouse-sponsored ITAS/ITAP and Retirement ITAS are not permitted to work in Indonesia

For Spouse ITAS, based on the regulation, a spouse visa permits foreigners to run businesses for the purpose of making a living and taking care of their family. However, this regulation does not specify what businesses foreigners on a spouse visa can or cannot undertake, as long as they do not hire any employees or work in an informal sector.
